noostar.com - Graham Norton's talent spotting site
I was just about to finish creating my performer page when I spotted a little nasty in the Ts&Cs (quite similar to those of Facebook.com actually)... note:
- That Noostar may use your name and the material you have posted for promotional purposes.
- That you grant Noostar a free, non-exclusive, irrevocable, worldwide licence to copy, sub-licence and display all material you post on the site for all Noostar's business purposes.
And that's word-for-word, verbatim from http://www.noostar.com/site/faq
So, beware! In uploading a photograph to noostar, you could (potentially) end up with your photograph being used in a "talented? Or talentless? You decide"-type advertising campaign for the website, implying that, perhaps, you are the talentless one.
On the other hand, if you were to win the competition, it's potentially some great exposure!WARNINGWarning: This is an Old Thread

im just about to start creating performer profiles on networking sites etc and thats something i was wondering about. Is facebook the same then? Something to think about!!

I'll go find the Ts&Cs. A photographer I use asked me politely not to upload any of his photographs to Facebook as in uploading them one was sub-licensing the copyright...
"By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses of the foregoing."

It also says, in not so many words, that you (as uploader) are responsible for ensuring you have the license to upload the content you post. So, if I post an image by "Alpha Bett", and Alpha Bett issues legal paperwork to Facebook for copyright infringement, Facebook could/would claim indemnity as I had agreed to the Terms & Conditions which stated that I take responsibility for all content I upload.
But, as always, the bottom line is usually who has the most powerful lawyers when it comes to matters of copyright...

I only use facebook for real friends and am deleting several people that I friended (but don't actually know) and keep "spamming" me with crap videos and pokes. (F**k off with this filling up my inbox!!) I use myspace for networking and promotion and am now going back and making sure that all photos are labelled on the image to reduce them getting pulled at random for anything other than web stuff. (small filesize!)

Ohhh I know some great stories about Graham Norton from working the doors in Manchesters gay village!!!! But then I'd probably get done for slander in sharing...
